Blue Collar Pro Plan – Maintenance Agreement
AGREEMENT DATE: Date of payment submission and acceptance
EQUIPMENT DETAILS: Equipment details to be recorded during first scheduled maintenance visit
Membership Fees:
Customer shall select a plan and pay the rate as indicated in the Maintenance Plan Selection section. This monthly fee shall remain in effect for the initial term of this Agreement and is subject to adjustment upon renewal. The amount shall be adjusted annually to reflect any changes in the Service Company’s cost of labor and to reflect any changes in the costs of the parts, equipment, and materials supplied by the Service Company under this Agreement. Amounts due to the Service Company will be billed to the Customer on a monthly basis and will be due and payable within 3 days thereafter.
Payment Schedule: Monthly auto-payment will process on the 1st of each month. Payment must be received within 3 days to maintain Good Standing.
Minimum Commitment & Cancellation Policy:
By enrolling in monthly payments, Customer commits to maintaining their Pro Plan in Good Standing for a minimum of 12 months from the Agreement Date. If Customer cancels before completing 12 months, Customer will be charged for the remaining balance of the 12-month commitment period. Either party may terminate this Agreement with 30 days written notice. Customer must provide written notice via email to info@bluecollararizona.com. Upon cancellation, retroactive charges will apply as outlined in the Membership Continuity section above.
Plan Benefits & Limitations:
All plan benefits are subject to the following terms and conditions:
Silver Plan:
¹Free Capacitors: Limited to 1 per year
Gold Plan:
¹Free Capacitors: Limited to 1 per year
²Free Drain Line Safety Switch: One per plan
³Free Refrigerant (410a): Limited to 3 pounds per year
Terms and Conditions:
- Good Standing:
Good standing means the Customer maintains an active Pro Plan membership with current monthly payments. A Customer is considered in Good Standing only when all monthly membership fees are paid in full and on time. Failure to maintain Good Standing may result in suspension or termination of maintenance agreement benefits.
- Membership Continuity and Retroactive Charges:
The discounts, rates, and benefits provided under this Maintenance Agreement are conditional upon continuous, active membership in the Pro Plan club. If Customer enrolls in the Pro Plan to receive discounted pricing under this Agreement and subsequently cancels their membership, Customer acknowledges and agrees that:
(a) All services performed during the period of membership will be retroactively billed at standard non-member rates; and
(b) Customers will be invoiced for the difference between the member discounted rate and the standard rate for all services rendered during their membership period.
Customers shall remit payment for any such retroactive charges within [30] days of invoice date.
- Maintenance Service:
Blue Collar Mechanical shall maintain and service the COMMERCIAL & RESIDENTIAL HVAC and maintain the equipment in good working order and provide scheduled preventative maintenance during regular business hours. In addition, Blue Collar Mechanical will provide unscheduled remedial maintenance (“on-call service”) as and when needed.
*Blue Collar Mechanical will perform minor repairs under this maintenance Agreement including: corroded thermostat wire, low voltage repairs, copper line insulation, missing service valve caps, brushing return grill to remove dust, etc. The benefits of this Agreement remain valid only while the Customer maintains Good Standing. Any additional warranties provided with the Pro Plan are void if the Agreement is terminated.
- Excluded Services:
Unless authorized in writing by the Customer, the Service Company shall not be required to make any of the following: Other safety tests or installations, whether or not recommended or directed by governmental authorities or by insurance companies; Any replacements with parts of a different design; Repairs or renewals caused by negligence or misuse of the equipment or any other factor, except ordinary wear and tear.
- Trained Personnel:
All services under this Agreement will be performed by qualified, licensed HVAC contractors who meet Blue Collar Mechanical’s training and certification standards. Each technician will use reasonable care in the performance of his or her duties.
- Term of Agreement:
The term of this Agreement shall commence on the date signed below and continue in full force and effect until it is terminated.
- Limitation of Liability:
Service Company’s liability under this Agreement shall not exceed the total annual membership fees paid by Customer.
- Force Majeure:
Neither party shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including acts of God, natural disasters, war, or labor disputes.
- Assignment:
This Agreement may not be assigned by Customer without written consent of Blue Collar Mechanical. Service Company may assign this Agreement to qualified contractors.
- Entire Agreement:
This Agreement constitutes the entire agreement between the parties and supersedes all prior agreements, whether written or oral.
ACCEPTANCE OF AGREEMENT
By checking the box and submitting payment, you acknowledge that:
- You have read and understood all terms of this Maintenance Agreement
- You agree to be bound by all terms and conditions stated herein
- You authorize Blue Collar Mechanical to charge the payment method provided
- This electronic acceptance has the same legal effect as a handwritten signature
- The date of your payment submission constitutes the Agreement Date
